Colo-vaginal fistula s/p laparoscopic surgery for cholecystitis, diverticular disease and severe stricture of the sigmoid colon.

On 3/4/10 the patient underwent a laparoscopic cholecystectomy and laparoscopic sigmoid colectomy by the insured physician. On 3/20/10 the patient presented with fecal-covered string-lilke material protruding from her rectum which was gently pulled out by another physician.

Patient alleged there was a retained endocatch bag used during the 3/4/10 surgery which was noted to be protruding from her rectum on 3/20/10. She also alleged that she developed a colo-vaginal fistula as a result of another physician pulling the string-like material from her rectum.

Favorable expert opinions were obtained on behalf of the insured physician. In addition, after a thorough investigation there was absolutely no evidence whatsoever that the string-like material protruding from the patient's rectum on 3/20/10 was part of an endocatch bag from the 3/4/10 surgery. A forensic pathologist performed non-destructive testing of the material and concluded that the fibers were not consistent with an endocatch bag or any materials used during the 3/4/10 surgery, and most likely the item was suture material from a pubovaginal sling procedure the patient had several years prior to the 3/4/10 surgery. In addition, plaintiff's forensic pathology expert could not testify within a reasonable degree of medical probability that the material was part of an endocatch bag. He also testified that the item could be consistent with suture material.
