PATIENT PRESENTED WITH A FRACTURE OF HER LEFT ANKLE.THE INSURED WAS CALLED IN TO CONSULT AS THE ORTHO SURGEON.THE PATIENT ALREADY HAD A SPLINT APPLIED WHEN THE INSURED FIRST SAW HER, SHE WAS PROVIDED WITH A SPLINT AND A FEW DAYS LATER SHE WAS PUT ON A SHORT LEG CAST WITH A WALKING BOOT.HE ELECTED NOT TO PERFORM AN OPEN REDUCTION DUE TO HER DIABETES AND RENAL FAILURE AND GENERAL POOR HEALTH.PLAINTIFF DEVELOPED AN OPEN PRESSURE WOUND ON THE LEFT HEEL.PLAINTIFF CEASED TREATING WITH DR. BILOTTA AND BEGAN TREATING WITH ANOTHER PHYSICIAN.SHE WENT ON TO HAVE A NON-UNION OF THE DISTAL FUBULA AND MEDIAL MALLEOULUS AS WELL AS DEVELOPING A CHARCOT JOINT.

BILOTTA WAS PLACED IN A POSITION WHERE HE HAD TO MAKE A JUDGMENT AS TO HOW TO TREAT THE PATIENT WITH HER CHRONIC CONDITIONS.BASED UPON THE FACT THAT THE FRACTURE WAS NON-DISPLACED, AND THE PATIENT WAS NOT PHYSICALLY ACTIVE AND WAS AT A HIGH RISK FOR SURGERY DUE TO HER MEDICAL CONDITION, HE DECIDED TO PLACE HER IN A CAST AND NOT PERFORM THE SURGERY.
