It is alleged based upon the doctor¿s misread of the x-rays, the claimant was discharged to a local nursing home, where he underwent painful physical therapy with a fractured vertebra.He suffered progressive neurological decline and, ultimately, paralysis due to spinal cord compromise.He has recovered some use of his legs but remains paraparetic and unable to walk without extensive assistance.

The x-rays arguably depict were review by the insured doctor, and it was determined by him to show ¿no acute thoracic spine Abnormality.¿In fact, the x-rays arguably depict wedging at T-9, suggestive of fracture; a horizontal fracture at T-10; pleural opacity, suggestive of thoracic vertebral fracture; wedging at T-11; as well as paraspinal swelling at these three levels.It is alleged that the doctor failed to note any of these findings.
