Patient Jace Manning suffered a skull fracture with edema and blood on the brain, sustained from what appeared to be a crushing injury.

It is alleged by Plaintiffs that the Defendants failed to recognize signs of child abuse in few presentations leading up to the eventual crushing injury the child sustained at the hands of his mother or her boyfriend. These presentations involved episodes of diagnosed sleep apnea and diaper rash from October, 2005 through early December, 2006.

It is alleged that Defendant Dr. Furia misdiagnosed the child abuse suffered by Patient Jace Manning. This is alleged depsite Dr. Furia's diagnosis of child abuse on 12/1/2005, two months prior to the crushing injury which Jace Manning sustained which resulted in his permanent injury.

Dr. Furia appropriately diagnosed child abuse in this case, at a time when the injury to the patient could have been avoided with appropriate action by the State. In accord with PIRRGA's recognition of the large problem that is unreported child abuse, and the large loss exposure attendant thereto, PIRRGA has refocussed its insureds on the criteria for reporting child abuse as established by the appropriate academic institutions by bringing this topic to discussion during monthly insured peer-review teleconferences.
