Principal Injury Giving Rise To The Claim
Patient initially presented to insured in September 2004 with complaints of a painful, left bunion.She was treated conservatively at that time.After approx. one year, she returned to insured again and subsequently underwent surgery on 11-17-05.She treated with insured until 12-22-05.Thereafter, patient sought care from a number of other doctors with continuing complaints of pain in her left foot. Patient claims too much bone was removed during surgery, which has resulted in degenerative joint disease, arthritis, need for joint replacement surgery and pain.She alleges the performance of a modified McBride bunionectomy was a contraindicated procedure and asserts that insured should have performed an osteotomy bunionectomy.The McBride procedure has less chance of developing a complication, less convalescence, and allows for a faster return to work compared to an osteotomy.Patient¿s deposition testimony shows that healing time and returning to work timely were concerns for her, and she did not want to take 4-6 weeks off from work.Indeed, she returned to work three weeks following surgery.
