Alleged failure to perform a splenectomy secondary to a laceration of same post MVA.
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
Claim that a splenectomy rather than a embolization should have been performed to avoid a massive bleed and hypovolemia. The competing issue was patients underlying transplant surgery years prior and the increased risk of aggressive surgery to remove the spleen. Further, it was not clear that the spleen injury actually caused the patients death.
