Patient presented to insured on 05-13-10 with complaints of pain involving the 4th IS of the right foot associated with macerated tissue.X-rays were said to demonstrate hypertrophic bone.Gentian violet was applied to the 4th IS and surgery was scheduled and then performed on 07-24-10. On the second post-op day, patient was experiencing significant pain.Odor, redness and swelling were noted at the surgical site, and patientÂ¿s antibiotic was changed from Keflex to Bactrim DC.When he returned to insured on 07-28-10, he was diagnosed with an abscess and cellulitis and admitted to the hospital, where IV antibiotics were administered. Patient claims continued pain and alleges insured failed to properly treat his condition and to perform an appropriate examination prior to performing surgery.
