Final Diagnosis For Which Treatment Was Sought Including Patient's Actual Condition
The claim arises out of the patient¿s admission to Bay Medical Center on May 6, 2009. He was admitted for multiple issues, including shortness of breath, chest pain, plural effusion with possibly empyema, and possible sepsis. Dr. Owens was the patient¿s admitting physician and hospitalist. The patient underwent a thoracotomy on May 7, 2009 and remained sedated andintubated until May 9, 2009. The patient developed a decubitus ulcer starting the morning of May 9, 2009. Dr. Owens was no longer on the patient¿s service as of the night of May 8, 2009.
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
It was alleged that Dr. Owens did not set in place proper precautions to prevent the Plaintiff from developing decubitus ulcers while he was intubated. However, precautions were in place, including a special mattress in the ICU, orders to turn the patient every two hours once he washemodynamically stable, and a nutrition consult. The patient was not hemodynamically stable until around 5 am on the morning of May 9, 2009. Prior to that, the nurses were using pillows tooffload some of the patient¿s weight, but were not able to fully turn him. At that time, the nurses turned the patient and noticed a red marks near his coccyx. The patient was ultimately diagnosed with a deep tissue injury.

There was no misdiagnosis in this case. The patient was diagnosed and treated for all conditions appropriately.
Principal Injury Giving Rise To The Claim
The patient developed a deep tissue injury to his coccyx area. There was expert testimony that indicated the deep tissue injury may have started developing before the patient presented to the hospital. There was no way to identify the deep tissue injury until the red marks developed and came to the surface of the skincame to the surface of the skin. The patient received treatment right away, but the treatment as directed by a different physician because Dr. Owens was off the patient¿s service before the deep tissue injury was discovered. The patient also had several biological factors that contributed to his development of the decubitus ulcers, including obesity, smoking, poor nutrition, and diabetes. Everything that could have been done to prevent the ulcers was done. If the patient had been turned any sooner than he was, he could have suffered a catastrophic event, including cardiacarrest and death.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
