Allegation of failure to diagnose caudal equina syndrome in 39 YOF patient resulting in urinary incontinence.
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
On 11/07/14, plaintiff presented to the ER with complaints of back pain from lifting an object that was consistent with her history of low back pain; she was appropriately assessed and the physical examination include a neurological exam that was negative; she made no complaints of urinary incontinence; there was no signs of saddle anesthesia; she had been ambulating well without difficulty; there was no reason for the ER to suspect Cauda Equine Syndrome.On 11/08/14, she again presented to the ER where a CT scan was taken and compared to a prior MRI that was consistent with no new acute changes; there was no need for an emergent MRI.On 11/10/14, according to Dr. Bellingar¿s office notes, the patient complained of incontinence and there were paravertebral spasms in the lumbar spine. Straight leg raising test was positive on the left. There was decreased range of motion in flexion, extension, rotation, and side bending in the lumbar area.The defense standard of care expert was wholly supportive of Dr. Bellingar and opined that the patient had a long-standing history of back pain; thus, there was no indication of an acute problem when she presented and thus no reason to suspect she was dealing with a patient w Cauda Equina.The suit was dismissed by way of a motion hearing on 11/15/18.
