Principal Injury Giving Rise To The Claim
Patient presented to the insured on 3/9/09 with complaints of syndactyly between the second and third toes bilaterally. She requested surgery to have the toes separated, but had no other complaints.Surgery was performed on 4/16/09 on both feet.The following day, patient called and indicated that her foot was quite painful.Insured changed the pain medication but, then later in the day, the patient called and indicated that the second and third toes on her left foot were a dark purple color and were still numb. The insured recommended that she come to the office immediately. At that point the second left toe was noted to be warm, but there was sluggish refill. Treatment options were discussed with a vascular surgeon as well as another podiatrist, and the insured instituted treatment consisting of a nitroglycerin patch on the dorsal foot. Over the next several days the color appeared to improve, and she began to develop a small serous blister at the distal aspect of the left second toe.Patient was then referred to a vascular surgeon and, on 4/24/09, she began hyperbaric oxygen treatments.Follow-up thereafter was provided at the local wound care center. The patient was not seen after 4/22/09 by the insured.Patient claims she developed ischemic necrosis of the 2nd digit of her left foot (the right foot healed with no problems).Although patient requested surgery, she alleges insured was negligent in performing unnecessary surgery and in the use of epinephrine.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
