Insured began treating patient in November 2005, and the ulceration appeared to be continuously improving at each visit; however, following surgical debridement in January 2006, patient had problems healing the wound, and she was given a referral for pain management for evaluation and treatment. Subsequently,patient came under the care of an orthopedic surgeon who took patient to the OR and performed debridement, bone resection and biopsies.The biopsy was eventually returned as being positive for squamous cell carcinoma.The patient underwent a BKA and eventually died from the cancer in 2007.It is alleged that insured failed to diagnose the carcinoma in a timely fashion.
