This 59 year old patient sought definitive care for severe osteoarthritis in his knees.After conservative measures were exhausted, informed consent for a total joint replacement procedure including preoperative instructions and a referral to his family physician were accomplished during two office visits. Additionally, prior to surgery, two anesthesiologists evaluated and cleared the patient for the procedure, rating him an ASA II, denoting mild systemic disease.An uneventful elective total knee replacement procedure was performed in the hospital on May13, 2003.The following day, the patient developed an elevated heart rate, shortness of breath and was determined to be having a myocardial infarction.Despite aggressive medical therapy by an interventional cardiologist and heroic resuscitative measures, no reasonable chance of recovery was felt to exist and the family elected to discontinue life support.The patient expired May 14, 2003.A private autopsy confirmed the cause of death to be from a sudden cardiac event: rupture of plaque with occlusion of the right coronary artery.The pathologist testified that surgery was not causative of this event, which was also not predictable.While no complications were anticipated during this procedure, detailed procedure specific informed consent did include possible complications including heart attacks, which could be fatal.Strong orthopedic expert support was obtained and the matter proceeded to trial.Prior to jury deliberation an economic decision was made to settle the case with no admission of liability.
