Patient was suffering from Stage 1 lung cancer, along with a very complicated medical history which included mytonic dystrophy, COPD
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
Patient presented for surgery for lung cancer. during intubation, a mass was found in patient's throat, located supraglottic above the epiglottis. The mass was discussed with the surgeon. Appeared to be benign and solid and it was decided it was more important to proceed with the lung surgery.

Principal Injury Giving Rise To The Claim
No injury occurred during this first surgery for the lung; a second endoscopic procedure was performed. It was during this procedure that a large supraglottic cyst was found on the dpiglottis filled with mucous. Although benign, it was alleged that it was filled with infectious material which had to be aspirated during intubation and/or extubation. As a result, patient became critically ill with severe lung infection and was hospitalized for 2 months.
