Diabetic patient presented with swelling and redness associated with his right second toe area.Insured felt patient had gout or cellulitis and recommended lab work; however, the patient refused.He was placed on an anti-inflammatory medicine as well as Keflex and was to return in several days; however, he did not return until approx. one month later.At that time he presented with a blister over the first metatarsal head.Appropriate shoes were discussed with the patient, but one week later he presented wearing Docksiders.Apparently a surgical shoe had been dispensed previously, but the patient indicated he would not use this particular device. Over the course of the next several weeks the patient continued to wear regular shoes despite the admonitions of the insured to use his surgical shoe or else some type of diabetic shoe.On 6/1/04 the patient was noted to have an ulceration which extended to the medial aspect of the first metatarsal head.Radiographs demonstrated bone changes, and he was referred to the wound care center.He was advised that he would need an MRI, intravenous antibiotics, as well as surgery.In addition, the insured noted the presence of a dislocated second MPJ.He was seen for his final visit on 6/2/04.Insured did make several phone calls to the patient to ascertain his status, but patient subsequently requested that he not call any further. Patient alleges improper treatment by insured.Per our expert, this is a classic case of the noncompliant diabetic who, when they develop a problem, wants to blame somebody else.This patient had previously been advised that he needed some type of vascular procedures, but refused.He was counseled on numerous occasions about using appropriate shoes for his diabetic condition, but refused.
