Claimant became insured physician's patient in 1995 with multiple medical conditions including chronic heart failure and frequent syncope.At some point, claimaint developed lung cancer which was diagnosed in July, 2002, due to testing directed by insured physician.Claimant had many chest x-rays due to his frequent encounters for cardiac procedures, including catheterizations and placement of a pacemaker.Five radiologists from the same group had evaluated those radiological studies and are accused of failing to report the presence of a malignant abnormality in the claimant's left lung.
