Final Diagnosis For Which Treatment Was Sought Including Patient's Actual Condition
On or about 11/20/14, Dr. Donald C. Sachs performed a lumbar discectomy using a "direct lateral approach" on the plaintiff at Winter Haven Hospital located at 200 Avenue F North East, Winter Haven, Florida; During the discectomy, it is alleged that while Dr. Sachs was performing the lateral spine procedure, he unintentionally perforated the sigmoid colon. On 11/21/14; Mrs. Williams was discharged from Winter Haven Hospital; Several days later, Mrs. Williams was taken back to the ER with severe abdominal cramps and told she had suffered a tear in her bowel. As with any spine surgery, in a lateral approach (Nuvasive XLIF), bowel injury is a complication, even with a posterior approach (although far, far less common). If there had been a bowel perforation at the time of surgery - as alleged- while it may not have been seen immediately, clinically, it would have been appreciated fairly quickly. The records immediately post-operative did not indicate any prolonged complaints of pain outside that which would normally be expected. Further, the patient had a history of abdominal surgeries and diverticulitis, and an anterior spinal approach would probably have been out of the question.
