The 58 year old patient with history of Hodgkin's lymphoma, coronary heart disease, coronary artery bypass grafting, and aortic valve replacement presented to the Emergency Department on 9/11/09 with chief complaint of fever of several hours duration.The emergency department physician made a diagnosis of lower leg cellulitis and recommended admission to the hospital, but the patient refused, per the physician. Blood culture final report of 9/13/09 indicated Strep pasteurianus.
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
The plaintiff alleged the admission to the hospital was not recommended.He wasseen by his private physician.His condition did not improve and he was ultimately admitted to Bayfront on 9/17/09 with pneumonia and bacteremia.The patient ultimately expired on 9/26/09.The patient had a large vegetation on the mitral valve.
