Principal Injury Giving Rise To The Claim
Insured treated patient for diabetic ulcerations for several months. His notes indicate there appeared to be healing of the ulcerations and continued improvement with no signs of infection. On her last visit with insured, patient reported a foul odor and drainage from one of the ulcerations.Insured confirmed this and immediately contacted her PCP to arrange for admission to the hospital for IV antibiotics. She subsequently underwent a BKA.Patient alleges improper treatment by insured. It should be noted that insured was consistently thinking about infection during his examinations of this patient as he references throughout his notes that ?there was no foul odor, purulence or redness?.Furthermore, home health nurses apparently observed signs and symptoms of infection at patient?s home; however, insured was never notified.
Severity Of Injury
Permanent: Major - Paraplegia, blindness, loss of two limbs, brain damage.
