Final Diagnosis For Which Treatment Was Sought Including Patient's Actual Condition
Patient admitted to the hospital on July 25, 2016 with presenting symptoms of acute expressive aphasia. Patient suspected of having an ischemic event.
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
On 7/19/2016 an otolaryngologist performed a balloon sinuplasty on the left and right maxillary sinuses, left and right sphenoid sinuses and the left and right frontal sinuses on this patient. The procedure was uneventful. following the sinuplasty, that physician observed his patient to ensure that no complications were incurred during the procedure. There were no complications noted. No bleeding, CSF fluid leakage, or complaints of headache. On 7/25/2016 the patient and his wife were driving and the patient became aphasic. The patient was taken to the emergency room where he was considered a "stroke alert". As a part of the stroke alert workup, and in order to determine whether or not the patient was a potential TPA candidate, a CT scan of the head was performed and interpreted by the radiologist. The radiologist's written report did not reflect any evidence of intracranial aneurysm or vascular thrombosis. However, he identified intracranial gas densities along the upper portion of the head. These findings were communicated directly to the ER physician. Also reported by the radiologist was the note stating, "I can't exclude a non-displaced fracture or gas-producing infection". As a result of the "stroke alert" status, Dr. Pantol, a neurologist, was consulted in the emergency room. Based on his workup, evaluation of this patient and the CT scan report, Dr. Pantol felt that TPA was an appropriate medication to administer. Dr. Pantol had a discussion with both the patient and his wife regarding the risks and benefits of TPA. The patient was administered TPA and did, unfortunately, have a small intracranial hemorrhage. Retrospective review of the CT scan revealed subtle indications of fluid densities in and around the gas densities that were identified previously by the radiologist. The area of the brain that would have been impacted by the gas/fluid densities was a different part of the brain than would be expected to have been impacted.

Principal Injury Giving Rise To The Claim
Failing to properly recognize the presence of intracranial gas along the convexities of the brain and recognize the presence of a left-sided superolateral frontal and parietal lobe extra-axial fluid collection with mass effect. This recognition would have avoided the order for the administration of TPA and the intracranial hemorrhage and the subsequent injuries to the patient that followed.
Severity Of Injury
Permanent: Major - Paraplegia, blindness, loss of two limbs, brain damage.
