Principal Injury Giving Rise To The Claim
Patient had treated with insured for many years and insured performed surgery on her left foot some years prior.On 03-20-09, he performed the same surgery on her right foot.There were no complications, and patient was instructed to ambulate with a cam shoe and crutches only and not apply weight to the right foot.At the first post-op visit on 03-26-09, x-rays revealed the first MPJ was completely dislocated, and insured advised patient that she had to be scheduled for surgery immediately.The surgery took place on 03-27-09 and involved an ORIF of the dislocation in the right, first MPJ.Of note is that prior to the second operation, patient reported that before her visit on 03-26-09, she stepped on her right foot and felt a sharp, cracking-type pain.Several post-op visits to insured did not indicate any problems; however, on 05-14-09, the distal IPJ was noted to be deviating laterally.Additional x-rays on 05-26-09 also revealed minor subluxation of the right MPJ.The last office visit with insured occurred on 09-16-09.Thereafter, patient sought a second opinion.Patient claims problems with continued pain and development of arthritis, which required further surgery.She alleges insured¿s surgery was negligently performed.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
