Principal Injury Giving Rise To The Claim
Patient presented to insured after suffering a sprained ankle.Bilateral, medial and lateral soft tissue masses/suspected lipomas of the ankles were noted and increased in size over the next 20 months.Patient requested removal of the lipomas. The surgery was uneventful, and the pathology report confirmed the suspected lipomas.Patient complained of post-op pain, which was initially addressed by insured; however, she was subsequently referred to both a neurologist and a pain medicine specialist for additional evaluation. Patient claims she suffered damage to the left sural nerve during the surgery and developed RSD.She also claims the lipomas recurred. She alleges the surgery performed was unnecessary and was improperly performed.Per our expert, patient?s pain and recurrence of the lipomas are known complications in lipoma excision cases. He believes that her claim that the sural nerve was severed during surgery was nearly impossible due to the presence of a positive Tinel?s sign as noted by the patient?s treating neurologist. He further opined that, had the nerve been transected during the surgery, patient would not have been able to feel pain, tingling or numbness in the area of the sural nerve distribution and would not have had any feeling in the area.As to the RSD, the examining neurologist found no evidence of RSD.
Severity Of Injury
Permanent: Major - Paraplegia, blindness, loss of two limbs, brain damage.
