Patient presented with complaints of recurrent plantar fibromas, which had previously been removed.Surgery was performed on 07-11-07.Post-op, patient was given a Rx for Vicodin and told not to drink any alcohol in combination with those narcotics.At a visit on 07-27-07, insured found a large hematoma at the side of the operative wound, and noted that patient admitted to drinking as much as 10 beers a day over the past two weeks.Insured further testified that he reeked of alcohol during this visit.Insured continued to treat patient¿s wound, which continued to slowly reduce in size.He noted patient was non-compliant with his wound care, using improper bandages and soaking his feet in ocean water, which contaminated the wound with bacteria.Due to his non-compliance, insured ultimately placed patient in a walking cast to protect the foot during ambulation.Patient claims continued pain and tightness in his foot and alleges the drain was removed too soon, which was refuted by two experts, and that the cast should have had a window or area to allow drainage.This was also refuted because leaving a window at the bottom of the foot defeats the purpose of putting a cast on in the first place. Our expert stated that patient¿s extreme non-compliance with post-op instructions led to the development of complications at his operative site, and these were appropriately treated by insured.
