Principal Injury Giving Rise To The Claim
On 7/5/07 the patient presented for the first time with ulceration under the fifth metatarsal head on the right foot.A culture was taken, and topical treatment was applied after the area was debrided.The patient was given gentamicin cream and soaks.By the visit of 7/18 it is noted that the C&S was negative and the lesion was ¿fairly superficial¿.An MRI was recommended to rule out osteomyelitis.X -rays taken on 7/18 do not seem to demonstrate any evidence of osteo.The lesion appeared to improve and by 7/25 it is noted to be ¿one half as big¿ as it was before since the patient was now wearing a pressure relieving shoe.On 8/1 it was noted that cat hair was found in the wound.This was patient¿s last visit with insured. Patient claims she developed osteomyelitis that led to a BKA and alleges insured failed to diagnose the infection.Our expert stated that by 07/25, it is clearly noted that the ulceration was one half the size as when it started out.This is evidence of good healing, which would not occur in the face of infection.Furthermore, the cultures taken by insured were negative, which would support that this was a local wound problem not secondary to infection.Because of this, it is possible that the wound was not actually infected at the time the patient was being treated by insured.Also called into question is patient¿s compliance due to multiple missed visits and the cat hair found in the wound.

Permanent: Significant - Deafness, loss of limb, loss of eye, loss of one kidney or lung.
