Principal Injury Giving Rise To The Claim
Patient presented to insured on 4/7/09 with a complaint of a left foot injury consisting of a fracture of the shaft of the fifth metatarsal that occurred when the patient fell down some stairs two days prior.The patient had been seen at an urgent care center where the x-rays were taken and a surgical shoe was dispensed.Examination revealed pain on palpation of the dorsal aspect of the lateral left foot with severe edema but no redness or bruising.Insured¿s assessment was a closed left fifth metatarsal fracture.Treatment consisted of application of an Unna boot and a fracture walker.The patient was advised to only bear weight while wearing the Walker and to limit his activity.At the next visit, patient advised insured he noticed pain in his left calf which started yesterday and had swelling in the foot; however over the past hour, the pain had subsided, and the swelling was down The patient was next seen on 5/12 at which time his overall improvement was rated as 100% and the patient described his condition as ¿non-painful¿; however, he did complain of intermittent swelling and pain in the left calf and ankle.On 05/21/09, patient was admitted to the hospital with a diagnosis of a saddle pulmonary embolism that required surgery.Patient alleges insured failed to recognize and order ultrasound for the potential of a DVT.
Severity Of Injury
Temporary: Major - Burns, surgical material left, drug side effect, brain damage.Recovery delayed.
