Patient developed compartment syndrome, resulting in allegation against insured of failure to diagnose.It should be noted that in the 3 days between patient's admission to hospital and the surgery performed by insured, there were upwards of 30 examinations of patient's leg performed by nurses and at least 4 docs.None of these examinations revealed any signs of symptoms that would be consistent with compartment syndrome.Based on the records, as well as the testimony of plaintiff's expert, there is no indication that patient was experiencing compartment syndrome until some time after the surgery.When patient presented to insured for follow-up following surgery, insured immeduiately suspected a compartment syndrome and ordered patient to go directly to the ER.
