Plaintiff alleges Dr. Eugene Murphy and Dr. Joshua Rovin failed to diagnose and treat chronic mesenteric ischemia (CMS) and instead performed an aortobifemoral bypass, which Plaintiff deemed unnecessary. They further allege that it led to an eventual hernia, bowel obstruction, perforation, sepsis, ischemic bowel and ultimate demise. Defense maintains patient had a near complete occlusion of the aorta, distal to the SMA, which mandated repair, and surgery was necessary, and that the medical issues and ultimate demise several months later were unrelated and not caused by their aorta surgery.

Aortobifemoral bypass x 2, aortic endarterectomy, mesenteric endarterectomy and implantation of the inferior mesenteric artery.

Plaintiff alleges defendants failed to recognize and treat chronic mesenteric ischemia. Defendants maintain plaintiff did not have chronic mesenteric ischemia, and surgery was necessary to address a near complete occlusion of the aorta.
Principal Injury Giving Rise To The Claim
Nearly four months postoperatively, patient presented with small bowel obstruction, bowel perforation, and severe atheromatous disease. She suffered an MI, necrotic bowel and an anastomotic leak post ileocolic resection. The patient¿s condition was not felt to be compatible with life, and she was placed on life support, which was withdrawn on 4/14/16. Diagnosis was perforated small bowel secondary to internal hernia causing bowel obstruction and necrosis of ileocolic distribution. Plaintiffs allege the surgery performed by Dr. Murphy and Dr. Rovin was unnecessary, which they alleged caused her hernia and subsequent bowel obstruction, perforation, necrotic and ischemic bowel, and other complications leading to her demise. Defendants dispute the allegations.
