Principal Injury Giving Rise To The Claim
Morbidly obese patient (weighing around 400 pounds) presented to the insured on 2/1/13 with complaints of severe pain associated with his bunions. Surgery was discussed and subsequently performed on the right foot on 6/13/13. The patient was seen postoperatively on 6/19/13, and again on 6/26/13. He remained non-weight bearing and immobilized on this extremity. His wife called insured¿s office on 7/22/13 and indicated the patient had expired the night before. Autopsy report revealed the cause of death as pulmonary embolism. Plaintiff alleges insured failed to delay the surgery until proper medical clearance was obtained, and that he failed to provide prophylactic anticoagulation therapy post-op on a morbidly obese patient.
