The Plaintiffs allege that Dr. Allen should not have relied upon the clinical findings of her Advanced Oncology Certified Nurse Practitioner, Ellen Stone, ARNP. The Defense maintains that the patient did not have any clinical and/or diagnostic findings to support the performance of random core biopsies until her visit on January 23, 2018, at which time a plan was set in place and random core biopsies were performed.
Principal Injury Giving Rise To The Claim
The Plaintiffs allege a delay in diagnosis of right breast cancer. The patient subsequently underwent a right breast mastectomy and a prophylactic left breast mastectomy followed by chemotherapy and radiation, all of which the Defense¿s experts contend would have been necessary regardless of when the diagnosis occurred given the aggressive nature and type of the patient¿s carcinoma.
Severity Of Injury
Permanent: Minor - Loss of fingers, loss or damage to organs. Includes non-disabling injuries.
