Principal Injury Giving Rise To The Claim
Patient was hospitalized on March 4, 2005, for complaints of fever and malaise. Specific complaints were followed and, on March 9, 2005, an ID consult was requested.She was diagnosed with a urinary tract infection. Patient was subsequently discharged from the hospital; however, there was not a definitive discharge diagnosis.After being discharged with antibiotics, patient returned a couple weeks later to the ER with complaints of nausea and vomiting.She was again admitted to the hospital, she claims, for a foot infection; however, the records bear out that again there was no clear source for the etiology.She was subsequently released from the hospital and continued to treat with insured for the next six months without complaints or evidence of infection.Nine months after her surgery and without evidence of foot infection, patient had pain complaints and treated with the ID consulting specialist from the hospital, who sent her to an orthopedist.His evaluation revealed no osteomyelitis; therefore, it would seem that during the time insured was caring for patient, she did not have osteomyelitis, as it would not have cured on its own. Patient alleges insured failed to properly treat and follow-up an infectious process.Our expert believes patient showed no clinical signs or symptoms of infection during the time insured cared for patient.Further, a timely infectious disease consultation was made and, from that point in time, the infectious disease physician controlled the issue.

Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
