Principal Injury Giving Rise To The Claim
On 02-17-10, patient presented to insured¿s office with a chief complaint of having ulcers on both feet. Upon examination, insured noticed a blood blister, suspicious of infection, on the lateral aspect of his left foot near the fifth metatarsal head.The area was debrided, cultures were taken, and insured indicated that arrangements for vascular studies would be made once the infection had improved.Additionally, she prescribed an oral antibiotic as well as a topical ointment.Insured continued to debride the ulcer over the next couple of visits, and she noted that the ulceration appeared to be resolving.Patient went to see the vascular surgeon, on 03-06-10, and testing revealed moderate ischemia in the left, lower extremity.When a subsequent MRI demonstrated osteomyelitis beneath the wound, insured ordered another appointment for patient with the vascular specialist.This doctor performed debridements but, as the wound began to deteriorate, he performed a left fifth toe and ray amputation.Due to unresolved ischemia and further deterioration, the vascular doctor subsequently performed a left below the knee amputation.Patient alleges the amputation resulted because insured failed to timely refer him to ID and vascular specialists.Our expert believes that with the patient¿s history of smoking andnon-compliance with diabetes management, more likely than not, he would have needed an amputation eventually, and that a several week delay did not cause or contribute to the need for that intervention.
