The claimant in this matter underwent elective shoulder surgery at an ambulatory surgery center in September 2007.After the procedure, while in the post anesthesia care unit, she requested an interscalene block for postoperative pain control.While Dr Ryan was administering the block, the claimant complained of nausea, followed by seizures and ultimately, asystole.Resuscitative efforts were successfully employed and the patient was transported by EMS to the hospital.She was discharged home, without deficit, on the third hospital day.Although rare, seizures and cardiac arrest are recognized risks of an interscalene block and were discussed, in advance of the procedure, with the claimant. Strong expert support was obtained as to Dr RyanÂ¿s standard of care and the matter was vigorously defended.For purely economic reasons to avoid the continued expense of pursuing the case through trial, a nominal settlement offer was made and accepted.Liability was specifically denied and the matter closed in November 2010 with an indemnity payment of $50,000.
