Principal Injury Giving Rise To The Claim
Patient presented to insured on 09-11-06 with complaints of a bunion and hammertoes.Surgery was subsequently performed on 10-09-06.The initial post-op interval was described as somewhat benign; however, on 03-19-07, she complained of ongoing pain in the left foot, which was addressed by insured.The last visit occurred on 02-04-08, at which time she was complaining of swelling and discoloration of the foot.Pain was noted on palpation, but there was no swelling.After leaving the care of the insured, patient sought services of another podiatrist but not until one year later on 02-26-09, primarily for an ingrown nail.She was seen on two subsequent occasions in March 2009 with complaints of left foot pain.Patient claims she has continued pain and alleges improperly performed surgery.Our expert stated patient had pre-existing degenerative change at the 2nd metatarsal; therefore, a Lapidus or some proximal procedure would have been optimal.He believes the complaints of midfoot pain post-op were likely due to pre-existing DJD.He further stated that post-op radiographs depict good correction of the HAV deformity that was maintained over time.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
