Principal Injury Giving Rise To The Claim
Patient was initially evaluated on 8/6/10 in a local ER for an injury sustained when a tire rim dropped on his foot and ankle.On 8/16/10 the patient was seen by a MD, and radiographs made by this doctor demonstrated possible fracture of the distal tibia and talus.The patient was referred to the insured for subsequent care, and was initially evaluated by insured on 9/14/10. Over the course of treatment, insured ordered a CT scan, MRI and bone scan, the results of which led insured to perform surgery on 12/15/10.Patient seemed to have a good recovery with no complaints; however, on 03/15/11, patient advised insured he had an incident at PT where he injured his operative foot during an exercise.Two weeks later, insured noted patient was complaining of pain for the first time.New films were recommended to see if exploratory arthroscopy would be necessary.On 05/17/11, the last visit with insured, it was noted that patient¿s pain had diminished; however, he was to follow up with ortho for possible arthroscopic surgery.Patient claims the distal screws used on the ortho-helix plate for the osteotomy were incorrectly placed, which resulted in degenerative changes. He alleges insured¿s surgery was negligently performed.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
