Principal Injury Giving Rise To The Claim
Patient was first seen by insured on 5-24-07 with complaints of a painful left, 1st metatarsal.She had significant bunion deformity to her left foot.Treatment alternatives were discussed, and patient elected to have surgical correction.During the post-operative care that occurred until March 2008, and then again in November 2008, patient did well; however, she had a persistent hallux varus deformity, which insured hoped would correct over time with the use of closed toe shoes. Unfortunately, patient did not heed insured¿s recommendations by vigilantly wearing closed toe shoes, which allowed the deformity to continue. When she returned to insured in November 2008, an additional surgical procedure to correct that deformity was discussed; however, patient declined and never returned to insured.Patient claims the varus developed because insured¿s surgery was negligently performed.Out expert stated that he believes this complication developed from muscle spasm of the abductor hallucis muscle following lateral release of the opposing muscle of the adductor hallucis.This complication could not have been anticipated by insured.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
