Diabetic patient presented to insured several times prior to event date of 10-18-01 for treatment of ulcers.On 6-28-01, it is noted that patient continued to have a painful right hallux.He was treated and instructed to return in two weeks but did not.Thereafter patient apparently sought care at a wound care center but did return to the insured for one final visit on 10-18-01, at which time ulceration was appreciated on the right hallux.According to information provided by patient's attorney, vascular studies were performed which showed PVD.Patient subsequently underwent a BKA.Patient died a few months later.This resulted in allegation of improper treatment by patient's wife.
