Final Diagnosis For Which Treatment Was Sought Including Patient's Actual Condition
The patient presented to the treating cardiologist with complaint of chest pain. An ECG performed in the office revealed anterolateral ischemia. The underlying diagnosis included chest pain, CAHD, DM with complications, carotid stenosis, aortic stenosis, mitral regurgitation, essential hypertension, hyperlipidemia, and obesity. The cardiologist performed a nuclear stress test which was interpreted by the insured physician.

The insured received data from a nuclear stress test performed by the treating cardiologist. No diagnosis or underlying clinical information was included. The insured provided a formal report to the cardiologist who signed off on the interpretations.

The insured physician provided an interpretation of the nuclear stress test which was reported to show no significant findings except for an expected area of peri-infarct ischemia. The treating cardiologist signed off on the report as well. The patient was seen again by the cardiologist who undertook no further intervention. The patient expired several weeks later. It was alleged that the nuclear stress test report should have included a description of ischemia and that had the report reflected such, interventions could have been considered to prevent the death of the patient.
