Principal Injury Giving Rise To The Claim
17-year-old nonrestrained driver who lost control of his car, hit a pole and sustained multiple acute injuries including a right comminuted calcaneal fracture.He was treated conservatively with a Jones dressing due to the swelling and it was determined he would not benefit from surgery due to severity of injury.He was seen in the office several days later and received a short leg fiberglass cast and followed for several weeks in the office. Plaintiff alleged failure to appreciate the extent and severity of injury, failure to diagnose the severely displaced fracture and take appropriate steps to repair said fracture, failure to discuss with the patient the risks and benefits of not performing corrective surgery or the options available, failure to perform surgery to repair the fracture and failure to perform a complete physical exam including taking orthopaedic measurements. However, defense experts supported the surgeon¿s course of treatment
