Principal Injury Giving Rise To The Claim
Patient developed an infection and was immediately hospitalized and underwent a surgical procedure.During the procedure, a piece of wood splinter was removed from the head of the 1st met area.Ultimately, during the hospital stay, the patient underwent a Symes amputation of the right foot.Patient alleges insured failed to discover the splinter and prevent the amputation. It should be noted that initial x-rays were negative, so there was no reason for insured to suspect a foreign body. In addition, our expert testified the likelihood is that the splinter entered the wound between July 12th and July 19th since the wound had been aggressively debrided prior to July 12th, and no splinter was found.In addition, on July 19th a new ulcer was noted by insured just proximal to the previous wound and was, most likely, the site at which the splinter entered.
Severity Of Injury
Permanent: Significant - Deafness, loss of limb, loss of eye, loss of one kidney or lung.
