Patient developed an infection and went on to have a BKA.Patient alleges improper treatment by insured.It should be noted that this patient was extremely non-compliant with insured as well as subsequent treating doctors.Insured advised patient to be non-weight bearing and not to work; however, patient related that he had just started a new job and could not be off work.Home health nursing care was also recommended, but the patient refused this option more than once. When insured last saw this patient, there was no evidence of infection, and our expert opines that prophylactic antibiotics should be deferred unless one sees signs of an infection.As far as a culture, without pus or any obvious sign of infection, there really would be nothing to culture.To get an appropriate culture, one would have to invade the wound to do a deep culture and, without evidence of infection, this simply would not be the standard of care.
