Final Diagnosis For Which Treatment Was Sought Including Patient's Actual Condition
Pltf. alleged that Dr. Kahn, ED physician, failed to recognize a Chiari I malformation on a brain CT causing a 3 month delay in treating the malformation.
Operation, Diagnostic, Or Treatment Procedure Rendered Causing The Injury
Pt. was seen in the ED for headaches.the ED physician was concerned about an acute process (i.e. a bleed) so ordered tests including a CT of the brain.It was properly interpreted as showing no acute intracranial pathology.Pltf. was instructed to follow up with his primary care physician within 3 days.He saw the dr. 6 days later and ordered an MRI that was interpreted within 30 days of the ED visit as showing a Chiari.

Misdiagnosis Made, If Any, Of Patient's Actual Condition
All experts agreed that MRI is the gold standard test for diagnosing Chiari.There was a dispute among the epxerts whether the CT scan showed any signs of possible Chiari.Our experts from Duke and the Univ. of Chicago were adamant that CT scans are not used to diagnose Chiari and that Chiaris are a chronic condition and pltf's neurological compromise would ahve been no different if he had been diagnosed and treated 3 months earlier.
