Principal Injury Giving Rise To The Claim
Patient was referred to the insured and was first seen on 9/1/15 for pain in the left foot. Insured diagnosed an ingrown nail and plantar fasciitis with heel spur and treatment with the insured continued for next 2 months with surgical options discussed. On 11/13/15 surgery was performed. First post-op visit three days later, the patient had mild erythema present on the great left toe and the K-wire was noted to be intact. The following day, the patient presented to the hospital with pain and was diagnosed with cellulitis. It was determined patient had MRSA present at the surgical site and the K-wire was removed. There was no amputation or lost tissue as a result of the surgery performed by the insured. Patient alleges insured failed to keep adequate medical records and failed to use modern sterile techniques while performing surgery.

Over the course of three years, he performed five minor surgeries, the final of which was performed on 05-28-13. Patient alleges insured left a gauza in her right foot, which caused discomfort for two and one-half months. The gauze was removed on 08-14-13.
