In March 2010 this 2 year old child ran into the street and was struck by a car.He was airlifted to the trauma center where a number of imaging studies were performed including a cervical spine CT scan.The study was interpreted by the on call radiologist, as revealing no fracture, and the impression was confirmed the next morning by Dr Green.The child was admitted to PICU with multiple injuries and cared for by a team of specialists.Some 72 hours later, the child developed new neurologic deficits and an MRI study confirmed edema and bleeding within the spinal cord.Transfer to a tertiary facility was arranged and in spite of heroic interventions, the child sustained a permanent neurologic injury from the impact of the auto accident.In March 2012, a lawsuit was filed against multiple parties. The plaintiff¿s theory of liability was based on a very sympathetic, permanently impaired child with a large economic damage picture.As to the radiologists, the allegation was a missed fracture.In spite of supportive expert reviews for Dr Green,as well as his contention that no fracture was visible on the CT study, in July 2012 the carrier elected to resolve the case within the limits of liability coverage to avoid the protracted time, expense and uncertainty of a jury trial involving a young child with complicated medical issues.
