Patient first presented to insured on 2/20/01 for complaints of hard, thick toenails that are difficult to cut and make it difficult to walk when long. She also had pain in ball of feet for several years which were increasing in severity with aching and throbbing pain which got worse if was on her feet a lot. Patient moved up north, but returned to insured on occasion for exam of feet and occasional procedures due to ingrown toenails. On 3/19/09, patient underwent phenol and alcohol partial matrixectomy of her left hallux. On 3/23/09, patientreturned to insured stating she did not change bandage on toe until 10:00 p.m. Friday night although it should have been changed much sooner.She had ischemic changes due to a partially remaining tourniquet. She was admitted to the hospital for IV antibiotics, wound care consult and podiatry consult, per insured, due to necrosis and cellulitis distal first ray, left hallux.Patient was then transferred to another hospital on April 1, 2009, at her request, for a second opinion and received hyperbaric treatments to salvage her toe.Patient alleges insured was negligent in failing to remove a tourniquet from her left, great toe.
