This 26 year old, 31 week pregnant female was the unrestrained driver involved in a July 2011 motor vehicle accident.She was transported by ambulance to a hospital emergency department for evaluation and treatment.Dr. Stavoy was on-call for obstetrics and, along with other specialists, was contacted by the ED physician.Shortly after her arrival, Dr. Stavoy personally examined the patient where he confirmed a fetal demise.Due to other injuries, the patient was then taken for a host of diagnostic imaging studies where a traumatic brain injury with subarachnoid hemorrhage and severe facial lacerations were found.The patient was admitted to ICU for close monitoring and the obstetric plan was to deliver the expired fetus within 24 hours. Unfortunately, the patient developed abnormal coagulation studies and Dr. Stavoy performed an emergent cesarean section delivery approximately 7 hours after her initial presentation to the ED.The patient never awoke after surgery, her condition deteriorated and she expired one week later. During pre suit evaluation, obstetric expert evaluation provided a supportive affidavit as to Dr. Stavoy¿s standard of care. Understanding the extreme sympathy associated with the death of a young woman who left behind a husband and two year old son, an economic business decision was made to resolve the case and avoid the uncertainty of a lay jury being able to set aside sympathy factors and focus on the science of medical treatment.With no admission of liability by Dr. Stavoy, the case settled in February 2013.
