Principal Injury Giving Rise To The Claim
The patient was pregnant and receiving prenatal care at The 7th Avenue Clinic.On 11/22/06 she had her first ultrasound study. During the study, the ultrasonography technician noted several abnormalities and went over to the Perinatal side of the clinic and requested Dr. Lowe come over to the ultrasound room. Dr. Lowe did so and performed some further ultrasonography on the patient. He agreed with the preliminary findings of dilated ventricles and a suggested ¿banana sign¿ which is consistent with the open neural tube defect (spina bifida). Dr. Lowe felt the patient needed to be referred to perinatology and the patient was given an appointment for 12/6/06.It is the Plaintiff¿s contention that Dr. Lowe never advised her of the abnormality on 11/22/06.The patient appeared for her 12/6/06 appointment and another ultrasound confirmed the previous diagnosis of spina bifida. The Plaintiff contends that it was on this visit of 12/6/06 that she first learned of the abnormality at which time she was already over 25 weeks pregnant and beyond the date under which she could have undergone an elective termination under Florida Law. Plaintiff contends that had Dr. Lowe advised her of the abnormality on 11/22/06, she would have been less than 24 weeks pregnant and could have legally terminated the pregnancy. The Plaintiff did deliver her baby in March 2007.The child is physically disabled by spina bifida. Liability was contested.A compromise settlement was reached without any admission ofliability.
