Insured had treated patient in follow-up to an I&D of small abscess done in hospital ER.Insured continued to follow patient for wound care and noted approx. 5 days later that there were no signs of infection in her right foot.She returned for follow-up in 1 month and had no complaints at that time, and there was no drainage noted.Insured's assessment was a wound that had resolved.Four days later, patient presented herself to the ER, and was admitted to the hospital, complaining of pain in her right foot.Insured continued the antibiotics that she was already on and ordered an MRI, which was negative; however, her condition worsened, and insured planned to perform an I&D the next day.Patient was subsequently transferred to the care of another podiatrist who performed the I&D and ultimately went back in and amputated two of patient's toes.Patient alleges that insured failed to follow-up on her condition.

Permanent: Significant - Deafness, loss of limb, loss of eye, loss of one kidney or lung.
