Based upon the above dataset the average indemnity paid for a medical malpractice lawsuit in Florida is about $446,000. We calculated this value based upon 16,000 cases from 1996 through 2020 with the highest number of cases (441, 450) occurring in 2016 and 2017 respectively.
From this same dataset we can roughly estimate that at least 88% of medical malpractice lawsuits in the state of Florida are a win for the plaintiff, keep in mind though that this does not take into account how many total lawsuits were filed.
We can also see settlement amounts by the severity of injury where 33% come from lawsuits with the severity of the injury was death but the highest percentage indemnity paid out was for grave quadriplegia, severe brain damage, lifelong care, or fatal prognosis.
