Principal Injury Giving Rise To The Claim
Patient first presented to insured?s partner and co-defendant in May 2003 with a painful right foot.He was diagnosed with plantar fasciitis vs. calcaneal stress fracture and dispensed a cam walker.Initially, he appeared to improve but later presented to insured?s partner with continued complaints of pain.An MRI was discussed but not scheduled at that time. Patient then returned on 5/27/04 and was evaluated by this insured.This doctor indicated that the patient had only recently undergone his MRI and that this demonstrated edema and cystic change at the talonavicular area.Tenderness was noted at this area, and a steroid injection was administered.Insured administered additional injections on 6/8/04 and 7/9/04.Patient was last evaluated on 8/23/04 with complaints associated with his right hallux nail.Patient claims he suffered degenerative changes of the talonavicular joint and went on to subsequent surgery with another doctor.He alleges insured failed to diagnose the destructive processes involving his foot.Our expert believes that regardless of when the talonavicular collapse was diagnosed, patient would have ultimately needed surgery.In other words, any alleged delay in diagnosing the condition did not cause patient to undergo surgery that he would not have otherwise needed.

Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
