Principal Injury Giving Rise To The Claim | |||||
Patient was first evaluated by the insured on 6/12/03 with complaints of painful bunions. She indicated that she had previously seen another podiatrist who had injected these areas on two occasions. Surgery versus conservative care was discussed, and surgery was subsequently performed on 9/11/03. Following surgery, the patient was noted to have rotation involving the osteotomy on the right foot in the first week after the procedure. On 10/2/03 the radiographs demonstrated loosening of fixation on the right side and surgery was performed two days later to relocate the osteotomy. Thereafter, there appeared to be no further disruption of this osteotomy, and the alignment at the first MPJ remained good. On the left side, the osteotomy appeared to heal uneventfully, although she developed medial deviation of the 2nd toe. She was last seen by insured on 11-12-03. Patient claims continued pain and alleges insured¿s surgery was improperly performed. | |||||
