Principal Injury Giving Rise To The Claim
Patient presented to the insured on 2/7/11 with complaints of painful bunions and hammertoes bilaterally. Surgery was discussed and subsequently performed on the left foot on 6/3/11. Patient fell 6 times within the first few days after her surgery, and was seen by the insured at her home on 6/9/11 for a redressing. Home physical therapy was ordered for her at that point. The wires were removed from the digits as well as the first metatarsal on 6/30/11. Radiographs were said to demonstrate adequate alignment and healing, and the patient was advised that she could begin ambulation slightly. She returned for a final visit on 7/28/11, at which point she was noted to have been hospitalized two days previous for DVT. Patient claims recurrence of the bunion and continued presence of the second metatarsal hammertoe. Patient is making claims with regard to the selection of the appropriate type of surgery, the performance of the surgery itself, and the post-operative care rendered by insured. She alleges the choice to perform outpatient surgery was negligent, and it resulted in her developing the blood clot.
Severity Of Injury
Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
